1. Acceptance of Terms

By accessing or using Archicite ("the Service"), operated by Yellowtrace Pty Ltd (ABN 52 163 859 498) ("we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Archicite is an AI-powered information tool that provides general guidance based on the National Construction Code (NCC) published by the Australian Building Codes Board. The Service is designed as a research aid for building and construction professionals.

3. Not Professional Advice

The Service does not provide legal, engineering, architectural, or other professional advice. Responses are AI-generated and may contain errors, omissions, or outdated information. You must independently verify all information against the current edition of the NCC and applicable state or territory legislation. Always consult qualified professionals for project-specific compliance decisions.

4. Limitation of Liability

To the maximum extent permitted by Australian law, Yellowtrace Pty Ltd and its officers, employees, and agents are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or reliance on the Service, including but not limited to errors in AI-generated responses, building code interpretation, or compliance decisions made using the Service.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information when creating an account and to notify us promptly of any unauthorised access.

6. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to reverse-engineer, extract training data from, or otherwise compromise the Service; (c) share account credentials or resell access; (d) submit queries designed to produce harmful or misleading outputs.

7. Intellectual Property

The NCC content referenced by the Service is published by the Australian Building Codes Board under the Creative Commons Attribution 4.0 International (CC BY 4.0) licence. The Service itself, including its design, code, and branding, is the property of Yellowtrace Pty Ltd.

8. Subscription and Billing

Paid plans are billed through Stripe. You may cancel at any time via the account portal. Refunds are handled on a case-by-case basis. Free tier usage is subject to query limits as displayed in the application.

9. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notice. Continued use of the Service after changes constitutes acceptance.

10. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
